1. Agreement to Terms

By accessing or using the website located at 3dcityskyline.com (“Site”), operated by 3D Services USA, LLC, doing business as 3D City Skyline (“Company,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of these Terms, you must not access or use the Site or purchase any products or services.

These Terms constitute a legally binding agreement. We reserve the right to modify these Terms at any time. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction. By using the Site, you represent and warrant that you meet this requirement.

3. Products and Services

3.1 Digital Downloads. We offer digital 3D model files generated from publicly available geographic data. Digital Products are delivered electronically in formats including STL, 3MF, and GLB. Digital Products are provided “as is” and “as available.”

3.2 Printed Models. We offer physical 3D printed models manufactured using professional 3D printing processes. Printed Products are custom-made and may vary slightly in color, texture, finish, and dimensional accuracy from on-screen previews. Such variations are not defects.

3.3 Accuracy Disclaimer. Models are generated from third-party geographic data. We do not guarantee models are perfectly accurate representations of real-world locations. Models are artistic interpretations intended for decorative, educational, and personal use only. They must not be relied upon for surveying, navigation, engineering, architectural, legal, or professional purposes.

3.4 Multi-Part Models. Large models may be divided into multiple parts for production. Assembly may require adhesive or materials not provided by us. We are not liable for difficulties arising from the assembly process.

4. Orders, Pricing, and Payment

4.1 Pricing. All prices are in USD. Prices are subject to change without notice. Applicable taxes and shipping are calculated at checkout.

4.2 Payment. Payments are processed securely through Stripe, Inc. on behalf of 3D Services USA, LLC. All charges on your statement and receipts will appear from 3D Services USA, LLC. We do not store credit card information on our servers.

4.3 Order Acceptance. We reserve the right to accept or decline any order at our sole discretion, including for pricing errors, suspected fraud, or Terms violations. Declined orders receive a full refund.

4.4 Taxes. You are responsible for all applicable taxes. Tax amounts are calculated automatically based on your address.

5. Shipping and Delivery

Estimated delivery times are guidelines only and are not guaranteed. We are not responsible for carrier delays, customs, or events beyond our control. Risk of loss passes to you upon delivery to the carrier. You are responsible for providing a correct shipping address.

Digital Products are delivered via download links. We are not responsible for download issues due to your internet connection or hardware.

6. Refund and Return Policy

6.1 Printed Products. We offer a 30-day satisfaction guarantee. Contact us within 30 days of delivery for a replacement or refund. Products must not be intentionally damaged, modified, or altered. Return shipping costs are your responsibility unless the product was defective.

6.2 Digital Products. All sales of Digital Products are final. Once downloaded or made available for download, no refund will be issued. Contact us for technical issues.

6.3 Refund Process. Approved refunds are processed to the original payment method within 5-10 business days.

7. Intellectual Property

7.1 Our IP. All Site content is our exclusive property or our licensors’ property, protected by copyright, trademark, and IP laws.

7.2 License. Upon purchase, we grant you a non-exclusive, non-transferable, personal license for personal, non-commercial use only. You may not: resell, redistribute, or sublicense products; use them commercially; claim ownership of underlying data or algorithms; or reverse-engineer any product or the Site.

7.3 Third-Party Data. Models use publicly available geographic data from third-party providers subject to their respective terms.

8. Prohibited Uses

You agree not to: violate any law; create models of sensitive locations for unlawful purposes; damage or impair the Site; use automated means without permission; attempt unauthorized access; circumvent security or pricing mechanisms; or use products for threatening or objectionable purposes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM: USE OF THE SITE OR PRODUCTS; THIRD-PARTY CONDUCT; INACCURACIES IN 3D MODELS; DAMAGES FROM MULTI-PART ASSEMBLY; OR USE FOR PROFESSIONAL PURPOSES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID IN THE PRECEDING 12 MONTHS OR $100, WHICHEVER IS GREATER.

10. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT UNINTERRUPTED ACCESS, ERROR CORRECTION, VIRUS-FREE OPERATION, OR ACCURACY OF ANY 3D MODEL.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company from any claims, damages, losses, or expenses arising from your use of the Site or Products, violation of these Terms, or violation of any third-party right.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA. Disputes shall be resolved through binding arbitration in Miami-Dade County, Florida per the American Arbitration Association rules. YOU WAIVE YOUR RIGHT TO CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

13. Termination

We may terminate your access immediately, without notice, for any reason including Terms violations. Upon termination, your right to use the Site ceases immediately.
